OUR RENTAL CONDITIONS
The legal relation between buyer/renter and TUXEN is decided pursuant to current Danish legislation with the elaborations, additions and amendments below. Any disputes are handled by the Maritime and Commercial High Court in Copenhagen.
At all times, it is the renter’s responsibility to be familiar with TUXEN´s rental conditions. These are always available at our website www.tuxen.dk or can be obtained via email by contacting us on phone +45 38889393.
When the contract is signed, the rent is paid as well as a deposit as agreed.
The renter must be at least 18 years old and have a VAT no. or a Danish social security number and address.
ID in the form of e.g. driver’s license, passport or other photo ID must be presented as well as social security card with valid address.
The minimum calculation per rental contract is a rental day, however at least DKK 100 plus VAT.
A rental day is calculated from the delivery day after 11.00 to the next day before 11.00 if no other agreement is made. When returning before the agreed time, the rent is not reimbursed for the remaining time.
The rent is at all times calculated based on the prices determined by TUXEN. The rental period starts on the delivery date at 11.00 and finishes at 11.00 on the return date unless otherwise agreed in writing. In case of late return of equipment, TUXEN has the right to debit extra rent as well as having the expenses covered in case of meeting another rental agreement.
Extension of the rental period must take place in writing and is not accepted until TUXEN has agreed.
Failure to return the equipment causes unconditional liability for damages, just as the renter is liable pursuant to § 293 in the Criminal Code (taking without the owner’s consent). If the agreed rental period is not kept by the renter, TUXEN has the right to pick up the rented equipment without warning at the renter’s expense. The same applies if the renter otherwise grossly violates the contract, e.g. by not paying the rent at the agreed time. Violation is also enforcement proceedings at the renter, bankruptcy or other suspension of payments. Such a violation does not give the renter the right to a reduction of the rent.
The prices are based on collection at our address, delivery/collection is made according to offers.
In connection with shipping, there is postage and transport + a fee of DKK 100 + VAT.
The rent is calculated from the shipment date until the equipment is back at our address unless otherwise agreed.
The rent must be paid even if the rented equipment is not used.
Any damage or deficiencies on rented equipment must immediately be reported to TUXEN AV-CENTER, if not, any rent reimbursement is out of the question. Hotline +45 61616000 or +45 26729393.
In connection with all rental of recording equipment, we are only responsible for the first medium. Any compensation is therefore only for the first medium at the purchase price and total or partly rental reimbursement. Apart from this, all compensation is ruled out regardless of how it has occurred.
We presuppose that the renter is capable of operating the rented equipment and therefore, the rented equipment is always rented at the renter’s responsibility. Damage to the renter’s or third party’s equipment/installation due to misuse is the renter’s responsibility.
All orders are accepted with reservations. There may be conditions outside our control so that we cannot deliver the ordered equipment. In such case, we are not liable for consequences which this may entail for the renter. Of course, we shall do anything in our power to find a solution in such cases.
The rented equipment is not insured unless stated in the contract.
It is not allowed to make adjustments or repairs on the rented equipment without prior permission from TUXEN.
TUXEN cannot be held responsible for any damage caused by the rented equipment. The rented part must not be handed over to others or sublet to a third party. The rented parts must not be taken outside the Danish border, unless there is a special written agreement.
The rented equipment must always be returned in the same condition as it was rented. The owner has the right to collect a fee of DKK 20 per cable if the renter has not ensured that all cables are rolled up correctly. At the same time, the owner reserves the right to charge the renter a fee if the rented equipment is not cleaned before returning, including removal of tape, glue residue, candle wax, beer, soft drinks, etc. Cables must be properly cleaned before returning. We currently charge DKK 460 + VAT per hour for cleaning equipment and cables, incl. helping materials.
ADDITION TO RENTAL CONDITION FOR BUSINESS CUSTOMERS
All prices are excluding VAT and other taxes unless otherwise stated. Verbal offers must be accepted immediately, otherwise they no longer apply. Written offers are valid for 10 days from the offer date unless otherwise indicated and after that, they no longer apply. Our price is the current price, determined on the time of making the offer, with reservations for increase in wages and material prices, currency fluctuations as well as changes in duties, shipping, transport and other costs.
If the contract is annulled later than 7 days before the first day of rental or production, the renter must pay 50 % of the rental price stated in the contract/order confirmation, however at least DKK 500 excl. VAT. If the contract is annulled later than 3 days before the agreed rental date, the renter is charged 100 % of the rental sum + a technician fee. This also applies to equipment which is not collected. Any annulment must be directly to TUXEN in writing. Extension of a contract must be in writing. Returning the rented equipment before the expiry of the rental period does not prompt a reduction in rent unless otherwise agreed in writing.
In case of cancellation, TUXEN reserves the right to invoice the actual defrayed expenses in connection with making an offer, planning and investments as well as fees for technicians and consultants.
Catering during sound and lighting productions
The organiser is always responsible for catering for TUXEN´s technical staff unless otherwise agreed in writing.
This may sound a bit snobbish, but it is only to ensure that our staff is catered for as it is often impossible to leave the place during the event.
During the entire installation and dismantling, we take care of catering ourselves.
Parking, access conditions, stage location, etc.
Offers for productions do not comprise parking or duties. It is always the organiser’s responsibility to obtain any parking permits, etc. for TUXEN’s vehicles. The registration numbers of our cars can be informed upon request. At the same time, it is the organiser’s responsibility that the unloading area is clear so that there is room for vans or lorries. If the equipment is not to be used at street level and it can be rolled all the way from unloading to the place of use, it is the organiser’s responsibility to inform this at least 5 weekdays before the start of the production. If the equipment is going to be carried manually to other floors than the load-in, the extra cost for movers/staff lies with the organiser or orderer. It is the organiser’s responsibility that the venue or layout clearly show where the installation must be and that the location of the stage is marked. If the erection of the stage has begun and completed correctly according to the drawing/instruction and the customer wishes a replacement of the stage/equipment, technician working hours are charged according to the current rate.
Conditions in connection with outdoor events
In connection with outdoor events, all effects must be efficiently ensured against the weather. Extra tarps or other coverage must be available. TUXEN reserves the right to override the renter’s initiatives and stop the production until necessary protection is made.
Power
It is always the renter’s/organiser’s responsibility that there is correctly dimensioned power max. 20 m from the stage or place of installation unless otherwise agreed. Dimensions of supply cables as well as the other installations must be according to the heavy current regulation. Active earth must be established. TUXEN offers heavy current distribution in the form of cables, panels and establishment towards payment. If you are in doubt about the power, then contact us.
Missing stagehands/helpers
If stagehands/helpers agreed verbally or in writing are not present, the responsible organiser is charged with an amount which is currently DKK 460 + VAT per hour. If one or more stagehands fail to appear, you must be aware that the time schedule maybe cannot be met and delays may occur. TUXEN cannot be made responsible if this happens.
Insurance conditions
Equipment rented at TUXEN as a business customer must always be insured against theft and accidents. Therefore, all rentals are imposed with a fee of 5 % of the gross rental price. The insurance is an all-risk insurance with an excess of DKK 10,000 and covers damage or loss of the rented arisen through damage, destruction or theft.
The insurance does not cover:
- Outside Denmark
- Scratches on any screens and optics
- Damage occurred due to spillage of drinks into the equipment caused by the renter or his guests, employees and representatives
- Damage caused by gross negligence by the renter or self-inflicted intoxication
- Consequential loss or other indirect consequence of the damage
- If the renter does not comply with the rental conditions
- Lost equipment which can be distributed/loaned to participants, etc.
- Simple theft
- If theft, destruction or sabotage is not reported to the police without unfounded delay
- If there are no clear signs of forced entry or the equipment was not kept in a locked room
- Theft from cars, trailers, vans and lorries.
In case of damage or theft, the renter must report this to the police immediately. At the same time, TUXEN must be informed immediately on phone +45 61616000 or +45 26729393.
TUXEN must receive a claim form from the renter as well as a receipt or copy of the receipt of the claim form to the police.
